In handling construction cases, our goal is to obtain successful results, either through trials or settlements, in a cost-effective manner. We know how to manage the review of the flood of documents generated by many construction projects. We do not endorse the "scorched earth" approach to discovery. Indeed, we find that excessive discovery in construction cases can drain valuable resources and impede the effective preparation of a case for trial. Our attorneys work to minimize litigation disruption through planning, preparation and experience.

WM&J attorneys have tried complex cases involving construction defects, negligent design and delayed completion. Those cases have involved nearly every aspect of a building, from foundations to roofs. The Firm’s clients include general contractors, engineers, architects, owners, subcontractors and consultants.

Our lawyers understand the importance of simplifying issues for a jury in construction cases, as such cases often involve complex facts, abstract terminology, and potentially confusing architectural and engineering concepts. At trial, models, charts, photos and when appropriate, computer animations, are used to provide the jury with a visual picture of what happened according to our client’s theory of the case.

Representative Cases

Two Prudential Plaza v. Turner Construction Co., Cook County, IL. Represented contractor to recover payments from owner and to defend against claims for negligent construction (roofs, curtain wall, welds, concrete in parking garage and fireproofing) and delayed construction of 64 story office building in Chicago. Jury verdict of $8.3 million for client.

Baker Mellon Stuart Construction Co. v. Metropolitan Water Reclamation District of Greater Chicago, U.S.D.C., N.D., IL. Represented owner of office, shop and warehouse facility in action against contractor for negligent construction (fire protection, curtain wall, masonry walls and HVAC) and delayed construction.

Global Granite & Marble, L.L.C. v. James McHugh Construction Co., County of St. Louis, MO. Represented construction manager in pursuing claims for payment and defending claims for alleged delay and construction defects arising from 230 room hotel project.

Sears Roebuck and Co. v. J.P.S. Elastometrics, et al., Cook County, IL. Represented roofing consultant to defend against claims for negligent design of single ply roofs on 450 facilities.

Mann, Gin, Ebel & Frazier Ltd. v. Martin & Lam, Inc., et al., Cook County, IL. Represented structural engineer to defend against claim for negligent design of supports for parking structure of concrete parking garage.
