Biography:
Mr. Huntington concentrates his practice on the defense of construction, product liability, transportation, commercial and civil rights matters in Illinois and Indiana state and federal courts. He has successfully represented corporations, banks, and municipalities in a wide variety of civil litigation and has successfully argued before the Seventh Circuit Court of Appeals. Mr. Huntington's practice has included defending numerous retailers and wholesalers in actions brought under the Indian Arts and Crafts Act.

Representative Cases:
Jensen v. City of Wilmington, et al., U.S. District Court, Northern District of Illinois. Defended municipality in lawsuit alleging "class of one" equal protection claim. District court entered judgment of dismissal against the plaintiffs. [Argued on behalf of appellee before the Seventh Circuit Court of Appeals. Court of Appeals affirmed judgment of dismissal.]
National Insurance Crime Bureau, et al v. Daniels, et al., U.S. District Court, Northern District of Indiana. Represented not-for-profit corporation in federal declaratory judgment action seeking injunctive relief. Presented argument at hearing on motion for preliminary injunction. Court granted preliminary injunction.
Reipsa v. Trump Indiana, Inc., et al., Circuit Court of Cook County, IL. Represented corporation in action alleging negligence and dram shop liability based on injuries allegedly incurred during a purported fist fight on its premises in Indiana. Court granted motion to dismiss for lack of personal jurisdiction.
Irving v. City of Elkhart, et al. Represented city accused of discrimination and retaliation. The court entered summary judgment for the defendant finding no adverse job action.
Neddef v. Northern Indiana Commuter Transportation District, et al., Superior Court of Lake County, IN. Defended transportation district and its officer in suit alleging false arrest and other claims. Court granted summary judgment for defendants.
Sim v. Worstell Construction, Inc. Represented construction company in AAA arbitration brought by homeowners alleging breach of warranty and other claims. Arbitrator awarded homeowners minimal award of one thousand dollars.
Published Opinions:
Dal Pozzo v. Basic Machinery Company, Inc., 463 F.3d 609 (7th Cir. 2006). Affirmed trial court’s award of costs and attorney fees against opposing third party defendant employer’s attorney as sanction for post-settlement obstructionism requiring motion to enforce settlement agreement.
Jaskolski v. Daniels, 427 F.3d 456 (7th Cir. 2005). Affirmed grant of defendant’s motion for preliminary injunction finding rule of criminal procedure prohibited defendant from disclosing federal grand jury matter.
Native American Arts, Inc. v. The Waldron Companies, 253 F.Supp.2d 1041 (N.D. Ill. 2003). Trial court denied plaintiff’s motion to reconsider ruling that it was inappropriate to retroactively apply the amendment to the Indian Arts and Crafts Act to allow the plaintiff to seek damages for conduct that occurred before the date of the amendment which granted Native American arts and crafts organizations standing to sue.
