Firm Litigators Obtain "Not Guilty" Verdict in Equal Pay Act Case

Jeffrey H. Lipe and Jordan D. Shea recently obtained a "not guilty" verdict in an Equal Pay Act case tried in federal court in Indiana.  The plaintiff, a wheelchair van dispatcher, filed suit against the firm's client, Superior Air-Ground Ambulance Service, Inc., alleging violations of Title VII and the Equal Pay Act.  Plaintiff alleged that male dispatchers were paid more than she was based on her sex.  The court granted summary judgment in favor of the defendant on the Title VII claim and on the equal Pay Act claim as to two male dispatchers.  The case went to trial under the Equal Pay Act in relation to a single male wheelchair van dispatcher.  At trial the defendant argued that the pay disparity between the plaintiff and the male comparator was due to factors other than sex, namely education and experience.  After deliberating for 30 minutes, the jury returned a "not guilty" verdict in favor of Superior.
