Ahearn v. Archibald Candy Corporation, Cook County, IL. Defended an Illinois food manufacturer in a national class action based on breach of warranty and Illinois Consumer Fraud Act claims. Successfully settled after the trial court denied in part the plaintiffs' motion for class certification and granted in part the defendant's motion for summary judgment.
Cohen v Blockbuster, Cook County, IL. Represent Blockbuster in a class action defense for charging late fees. Trial court refused to decertify the class. On appeal filed by Blockbuster to the Appellate Court of Illinois, First Judicial Circuit, the Court reversed the judicial estoppel finding and in March 2008 decertified the national case.
Anderson, et al v. New Dimension, et al., U.S.D.C., N.D. IL. Class action defense of a homebuilder and lender for violation of RESPA. Class certification denied. Remaining case settled for minor sum.
Boyd v. Phoenix Funding Corporation, et al., 3rd Judicial Circuit, Madison County, IL. Represented a lender in a class action under RESPA.
Marc Cohen, et al v. Blockbuster Entertainment, et al., Cook County, IL. Represent Blockbuster in a class action defense for charging late fees. Trial court refused to decertify the class. On appeal filed by Blockbuster to the Appellate Court of Illinois, First Judicial Circuit, the Court reserved the Judicial estoppel finding. On March 14, 2008 the trial court decertified the national class.
Doe v. Alpha Therapeutic Corporation, U.S.D.C., S.D. IA. Acted as Regional Counsel and obtained summary judgment in favor of manufacturer of hemophiliac clotting factor alleged to have transmitted HIV/AIDS through its medicine.
Frazier v. Equicredit Corporation, et al., U.S.D.C., N.D. IL. Represented a lender in a class action suit under TILA. Settled for a minimal amount after motion to dismiss filed.
Genetically Altered Corn Cases, U.S.D.C., N.D. IL. Defended the seller of flour contaminated with genetically altered corn (Starlink) in consumer class actions.
Hyatt Hotel v. Rose Acre Farms, Cook County, IL. Represented Rose Acre Farms in class action product liability and breach of warranty case involving 2,000 people who became ill at a Hyatt convention allegedly caused by salmonella in eggs supplied by our client, Rose Acre Farms.
Janikowski v. Lynch Motor Group, U.S.D.C., N.D. IL. Summary judgment, affirmed on appeal, in class action alleging TILA and consumer fraud based on auto dealer’s credit sales practice; outcome and appellate decision validated a widely used, profitable customer service provided by car dealers.
Ramsell v. Infinity Broadcasting Corp., et al., DuPage County, IL. Defense of breach of contract claim and Consumer Fraud Act for failure to refund concert ticket price to customers who did not hear refund offer on radio or by web site. Case settled for minor amount before class certification.
Rydel v. Comtrad Industries, Inc., et al., Cook County, IL. Defense against claim of unauthorized e-mails in class action complaint. Case won by dismissal.
Tishel v. Shell Oil Company, et al., Cook County, IL. Represented Phillips Petroleum Company in class action suit for high gasoline prices in Illinois. Obtained dismissal of case.
In Re Med-Pay Litigation, State Court, Canadian County, OK. Represent Zurich Services Corporation in defense of class action for claimed improper reduction of medical bills based on reasonable and necessary/geographical comparisons. Matter pending.
Asbestos Litigation, various courts in Midwest. Defended Eagle Picher and Standard Asbestos as regional counsel in thousands of cases claiming death and injury from inhalation of asbestos. Also defended other asbestos defendants, including Borg Warner, Brand Insulations, Atchison, Topeka & Santa Fe and Soo Line Railroads, ARCO, Bell Helicopter and Black & Decker.
